Introduction:

Within health and social care professions, it is vital that the service providers stick to the rules and
regulations in order to maintain good and efficient practice and ensure that health and safety is the
main priority.

One of these health and safety legislations and policies is the Health and safety at work Legislation
which according to the website Health and Safety Executive (nd) is the primary piece of legislation
covering occupational health and safety in Great Britain. It sets out the key duties which employers
have towards employees and members of the public, employees have to themselves and to each
other, certain self-employed have towards themselves and others. This legislation ensures that there
are no risks around the specific setting and ensures that there is no safety hazards for the service
users. by making sure that the setting where care is being provided, follows all rules and regulations
in terms of safety, the service users should feel comfortable being treated by the staff within this
setting. The Peterhouse Care Village Limited CQC report attached, said that Premises risk
assessments and health and safety assessments had been reviewed on an annual basis, which
included gas, electrical safety, legionella and fire equipment. The risk assessments also included
contingency plans in the event of a major incident such as fire, power loss or flood. Therefore, this
setting follows the health and safety legislation well.

Another legislation that health and social care professionals have to follow is the Food hygiene
(England) Regulations to ensure that the food that is prepared and provided is suitable for
individuals specific needs. The website Quittance Legal Services (nd) said that it places an obligation
on all 'food businesses' to make sure that their activities are carried out hygienically. The regulations
make it an offence to supply food which is unsafe to be consumed and harmful to human health.
When it comes to most professions in health and social care, catering to individual needs in term of
food is vital due to things such as allergies or conditions like diabetes that involve individuals
needing specific dietary requirements. Therefore, ensuring food safety rules are followed will have a
huge impact on service user’s health and wellbeing. The Peterhouse Care Village Limited CQC report
attached, said that people told them that the food was good and there was plenty of choice and
variety. Comments included, "Really tasty meals, sometimes the meat is chewy but usually very
good," "Lots of choice, we can have what we fancy really, homemade cakes, nothing to grumble at,"
and "Excellent now, we have a new chef, much better." Therefore, this specific setting has good food
hygiene standards and caters well for everyone.



Reporting injuries, diseases, and dangerous occurrences regulations is another legislation that
needs to be followed as in health and social care, ensuring that risks are minimized is key priority.
The Website Occupational Safety and Health consultants Register (nd) said that in order to be legally
compliant, a record must be kept of all incidents. If all incidents and accidents are reported, it means
that there is always a record of things that happen meaning if they need to be followed up on, this
can be done easily. Also, reporting and recording everything minimizes the risk of things happening

, again meaning that if there are any issues then these are likely not to be repeated meaning they do

records had not always been updated promptly following accidents or incidents to ensure staff
always had current information about the care people required.

Ensuring that service users data is constantly protected and kept confidential is vital especially in
health and social care. This is why the Data protection legislation was put in place and according to
the website NHS (nd) the Data protection legislation requires that the collection and processing of
personal data is fair, lawful and transparent. Maintaining confidentiality for service users if vital as it
can often improve the trust that a professional and a service user has between each other. As a
result, this means that care can be improved as the more a professional knows about their patient,
the more they will understand how to care for them effectively. Data storage means that all
information about a service user is stored away safely so if access is required on a need-to-know
basis then it can be easily retrieved. The Peterhouse Care Village Limited CQC report attached, said
that people's right to privacy and confidentiality remained respected. One person told us, "Staff
respect my privacy and at the same time they knock on my door and ask if I am okay." A visiting
professional commented, "I've never had any concerns about the staff, they respect people's privacy
when I visit."

Making sure that everyone is treated equally and fairly is important in every health and social care
profession and this is monitored by the Equality legislation. The website GOV.UK (nd) said that The
Equality Act 2010 legally protects people from discrimination in the workplace and in wider society.
Ensuring that everyone is treated equally means that conflict will be avoided which will therefore,
mean that there is less risk of injury. Also, the quality of care that people will be provided with will
be good for everyone meaning that there should be no issues when it comes to how an individual is
cared for. The Peterhouse Care Village Limited CQC report attached, said that everyone was
engaging and involving people using the service, the public and staff, fully considering their equality
characteristics.



All health and social care professions are controlled under the rules and regulations of the CQC also
known as the care quality commissions standards. The CQC carry out regular inspections to ensure
that the setting has no risks around to ensure that injury is prevented. The Peterhouse Care Village
Limited CQC report attached, said that they carried out their inspection on the setting under Section
60 of the Health and Social Care Act 2008 (the Act) as part of our regulatory functions, and checked
whether the provider was meeting the legal requirements and regulations associated with the Act.
They also looked at the overall quality of the service and provided a rating for the service under the
Care Act 2014.

Legislation and policies have a major influence on practice as, if followed appropriately, they
ensure that proper care is being given to the service users. The Health and safety at Work
legislation influences practice in multiple ways due to the fact it has an effect on all aspects of health
and social care. Firstly, it ensures that risk assessments are managed, and a safe working
environment is maintained, including safe moving, and handling and also ensures protection from
accidents, injuries, and illness, including infection control, food preparation, hazardous
