I will be justifying the strategies and techniques that can be used when overcoming ethical
issues and challenges experienced by individuals with different needs when planning and
providing care. Organisations, legislations and guidance will be discussed along with their
strengths and weaknesses.

There are organisations, legislations and guidance that can influence or advice on ethical
issues within the health and social care sector. These play a vital role in health and social
care provision, solving conflicts of interest, balancing resources and managing
confidentiality, their carers and/or families and service providers. There are also key pieces
of guidance that help health and social care services to tackle these issues.

In NHS continuing healthcare funding decisions, the DH Decision Support Tool is used. It is a
document that seeks to record documentation of the medical needs of a person to decide
whether they qualify for continuing support for healthcare. This is used when it is felt that
an individual needs additional assistance from a health sector. In this scenario, it is the
elderly Aisha who can no longer live in her own house alone. An assessment by a specialist
using a screening method called the NHS Continuing Healthcare Checklist would be the first
step. Using the Decision Support Tool, if the findings come back then she is eligible for NHS
continuing healthcare, a full up-to-date review of her needs will be arranged. In relation to
twelve treatment areas, multi-disciplinary teams set out their needs, and make a decision as
to whether she is entitled to NHS continuing health care.

For Valerie, the Five Step Framework is the principle of a step-by-step approach to ethical
decisions. When health and social care workers settle on strategies that can better assist
Valerie with her mental health, hearing impairment and obesity, this can be effective. It is
commonly used in health and social care facilities, such as the NHS. The NHS (National
Health Services) was introduced in 1948 with the premise that, regardless of income, decent
health care should be available to everyone. It offers a wide variety of health services, most
of which are free for legal residents of the UK at the point of delivery. For the Five Step
Framework: Step 1 - Recognize the decision or issue, identify the need to make a decision.
Step 2 - Think before you act make a prediction about which decision is most likely to give a
good outcome. Step 3 - Decide on a course of action, identify your feelings. Step 4 - Test your
decision. Step 5 - Proceed and evaluate, can you explain reasoning clearly and manage in a
discussion about the morals of your decision. If health and social care professionals require
help, they should follow these guidelines to make decisions regarding Valerie's route of care.

For Billy, he would benefit from NICE and NHS guidance on care pathways and care plans
which are designed for clinical, public health, social care, and safe staffing and medicines
practice guidelines. Technology evaluations, interventional techniques, medical technology,
guidelines on diagnostics and highly advanced technologies, quality standards,
accompanying equipment established by NICE to facilitate implementation. In Billy’s
situation, he could have care plans created for his needs, for example the healthcare
provider must identify what triggers the asthma attacks and have him see a therapist who
can sympathise with him and try to help him to understand why he needs to comply with
the professionals are telling him to do and to manage his stress because it could also trigger
an asthma attack, also it could help him get through his situation with his mother due to her
not wanting to see him.
