THIS PAPER CONSISTS OF THREE (3) PAGES. 1. The assessment counts 20 marks, consisting of two (2) questions. 2. The assessment is due on 10 August 2026. 3. This is an open-book assessment. You may consult your prescribed study material during the assessment. 4. Your typed answers must not exceed 1200 words. 5. Ensure that the following requirements are adhered to: 5.1 The text must be typed in Arial font, size 12. 5.2 1.5 line spacing; with justified text. 6. South African English and not American English should be used. 7. All quotes two lines long (or less) must form part of the main text and be bracketed by “quotation marks”. Where a quotation is longer than two lines, it must be typed in a separate paragraph in size 11 font, single line spacing and indented by 1 cm. No quotation marks are required when the quotations stand alone. Use quotations sparingly. A maximum of 5% of the text may be quoted. 8. When answering the questions, remember that an open book is a test at a higher level than the usual type of assessment, where memory is tested as much as insight. In an open-book assessment, you need not memorise any information. You are expected to prove that you can use information rather than merely repeat it. In brief, what is being tested is factual knowledge, understanding and the correct application thereof, not memory skills. PLEASE DO NOT CUT AND PASTE ANSWERS FROM THE E-RESERVES (OR ANY OTHER SOURCE OR PRESCRIBED MATERIAL). 9. The arguments that you make must be logical, well-structured and substantiated by all the relevant legal principles (in the form of footnotes, following the OSCOLA style). Use the time given wisely. 1 10. Students suspected of dishonest conduct during the assessment will be subjected to disciplinary processes. The use of Telegram, or any other instant messaging services with any other person is strictly prohibited. Plagiarism is a violation of academic integrity and students who plagiarise, copy from published works or use Artificial Intelligence Software (eg ChatGPT) or online sources will be in violation of the Policy on Academic Integrity and the Student Disciplinary Code and may be referred to a disciplinary hearing. UNISA has zero tolerance for plagiarism and/or any other forms of academic dishonesty. 11. Turnitin is used to check for similarity between your script and other students' answers as well as your script and all documents on the internet. Turnitin also detects the use of artificial intelligence (AI). Academic dishonesty will not be tolerated. When submitting Assessment 1, you MUST click on the End User License Agreement (EULA) so that a Turnitin report can be generated. Similarly, since Turnitin is used, submissions must be typed (no handwritten submissions will be accepted at all) and the submissions must have been saved as a PDF from the original Word version. No submission must have been scanned and saved. FAILURE TO FOLLOW THESE INSTRUCTIONS WILL RESULT IN YOUR ASSIGNMENT NOT BEING MARKED. NO EXTENTIONS MAY BE GRANTED. 12. You have 3 opportunities to submit Assessment 1 to check the Turnitin score. The 3rd time is the final time. Therefore, you must submit well in advance of the closing date to benefit. 13. Do not use the synonym function to change the words to evade similarity detection (eg: Pastor to replace Minister; or Financial Empowerment Warriors for Economic Freedom Fighters). Introduction

This legal opinion considers whether Regulation 8(2), issued by the Minister
of Correctional Services under the Correctional Services Act 111 of 1998, is
constitutional. The regulation prohibits prisoners from receiving or
possessing printed literature, books, or publications from outside sources
except official educational material supplied directly by registered public
institutions. Dumisani, a sentenced prisoner and practising Rastafari,
challenges the regulation after prison authorities confiscated his Holy Piby
and a cultural history magazine sent by his family. The opinion examines

prisoners despite their incarceration. While imprisonment necessarily limits
certain freedoms, prisoners continue to enjoy all constitutional rights except
those lawfully restricted by imprisonment.

The Holy Piby is a sacred religious text central to the Rastafarian faith.
Denying Dumisani access to this text substantially interferes with his ability
to practise and observe his religion. Religious texts are often indispensable to
