1.1 Dealing with the Mortgage Bond over Erf 3

Under Section 40(5) of the Deeds Registries Act 47 of 1937, a Certificate of Consolidated Title cannot be
registered if one of the component properties (Erf 3) is hypothecated under a mortgage bond, unless
the bondholder (Blue Bank) consents. Sarah and Steven must address this by obtaining the written

2. Extending Clauses for Unregistered Land
