The concept of law is a complex and multifaceted one, central to the functioning of any society. It is
not a simple, single definition but rather a system of rules with specific characteristics and a
profound social impact.

The study guide begins by acknowledging the difficulty in defining "law," as it is understood
differently by various people in different situations, encompassing everything from religious laws to
the laws of nature and the rules of games.¹ However, for the purpose of legal studies, the focus is on
a specific, strict definition: "Law in the strict sense is the only body of rules governing human
conduct that is recognised by the state and if necessary, enforced."²

This definition highlights three crucial, defining characteristics that distinguish legal rules from other
types of rules. First, the rules must be recognised by the state. This means they are not merely
personal, religious, or social norms; they are formally acknowledged and validated by the governing
authority of a country. Second, the rules are designed to control human actions and interactions,
regulating the relationships between individuals, groups, and the state itself. Third, the rules are
enforceable by the state. This means there are established mechanisms, such as courts and police, to
ensure compliance and apply sanctions for violations, which is what gives the law its binding and
authoritative nature.³

The study guide emphasizes a critical point: while law is essentially a system of rules, not all rules
are law. For a set of rules to qualify as law, they must fulfill all three of the characteristics mentioned
above (recognition by the state, control of human actions, and enforceability). Rules created by a
mother for her children, or the rules of a sporting code, might govern conduct but are not
state-recognized or enforceable in the same manner as law, thus they fall short of being legal rules.⁴
This distinction is foundational for understanding the unique role of law in society.

The purpose and function of law are deeply intertwined with its definition. The primary function of
law is to create and maintain peace, order, and stability in society. It does this by balancing the
interests of individuals with the interests of the larger community or state.⁵ This is achieved through
different branches of law. For instance, criminal law is concerned with conduct that offends public
order and peace. When a person commits a crime like murder or theft, the state intervenes to
prosecute and punish the offender on behalf of society, imposing sanctions such as imprisonment or
fines.⁶ On the other hand, civil law regulates relationships between private individuals. If one person
infringes on another's rights, such as by damaging their property, the wronged party can institute a
civil claim (sue) to seek redress, which may result in the court ordering compensation to restore the
harmed party's rights.⁷
