1. Critically evaluate how the environmental legal framework relates to morals and societal
values. In your answer, explain how environmental law differs from other social norms (such as
cultural practices and ethical behaviour) and how the environmental legal framework, as
opposed to social norms, gives effect to the environmental right contained in South Africa’s
Constitution.

 Answer 1

The environmental legal framework plays a crucial role in addressing environmental issues and
protecting natural resources in alignment with societal values and moral principles. In South Africa,
the Constitution enshrines an environmental right, which imposes a duty on the state to ensure that
the environment is protected for the benefit of current and future generations. This framework not
only reflects the moral values of a sustainable society but also offers legal enforcement to safeguard
these values.

Environmental law differs significantly from other social norms, such as cultural practices and
ethical behaviors. Social norms, including cultural customs and personal ethics, often guide
individual and collective actions based on moral reasoning, communal expectations, or societal
traditions. For instance, many cultures prioritize environmental conservation, but these principles are
not always legally binding or enforceable. On the other hand, environmental law is a formalized
system of rules that govern the interaction between humans and the environment. It is structured
through legislative instruments, regulations, and policies that compel compliance through legal
sanctions.

A key distinction is that environmental law explicitly outlines the state's responsibility to take
protective measures against environmental degradation, as outlined in Section 24 of the South
African Constitution. This legal provision mandates the government to enact measures to prevent
pollution, promote conservation, and ensure sustainable development. The legal framework in South
Africa, particularly through the National Environmental Management Act (NEMA), operationalizes
these principles by ensuring that any development serves the needs of both present and future
generations, integrating economic, social, and environmental factors into decision-making
(LEG2601, Study Guide, page 37).

Morally, there is an increasing societal acknowledgment that human activities should not harm the
environment, as this would undermine the quality of life for future generations. This societal
recognition is reflected in the legal framework’s emphasis on sustainability, equity, and justice. For
example, the concept of "intergenerational equity" underscores the moral duty of present generations
to protect the environment for the benefit of those to come (LEG2601, Study Guide, page 21). This
principle is supported by South African case law, such as in the Fuel Retailers Association case,
which emphasized the importance of equity between generations when considering environmental
protection (LEG2601, Study Guide, page 26).

Unlike social norms, which may be interpreted variably and lack enforceability, environmental laws
in South Africa are backed by the authority of the state. The government is obligated to implement
legal measures that directly give effect to environmental rights, and individuals or organizations that
infringe these laws can be held accountable. This is evident in cases like Hichange Investments
(2004), where the court ruled that individuals should not be compelled to live or work in
environments that are harmful to their well-being (LEG2601, Study Guide, page 37).
