1. The examination question paper counts 100 marks. The duration of the examination is from
14:15 to 18:15 (4 hours). In addition to the duration of the examination indicated on the
timetable, you are given 30 minutes to FINALISE the uploading of your exam file. Your
exam file must therefore be uploaded via the myExams platform on 23 January 2025
BEFORE 18:45 (South African Standard Time).

NOTE: The time on the myExams platform corresponds with the FINAL upload time. This
INCLUDES the extra 30 min. In other words, you must upload your script before
18:45.
There is no contingency link for the examination. You MUST upload on the myExams
platform.
2. The examination paper consists of three (3) questions. Answer ALL the questions and fully
substantiate by referring to your textbook, prescribed case law, articles and legislation
where applicable. Do not include footnotes. Instead refer to the relevant prescribed sources
that you consulted in brackets following statements made to answer the question. Although
we encourage you to use the prescribed OSCOLA referencing style in your references we
will not penalise you if the referencing style is not faultless.
3. Strictly adhere to the indication regarding the number of lines that each answer
should consist of. You will be penalised if you do not adhere to this.
4. Please do not include the questions in your submitted answers. Number answers
correctly and chronologically.
5. Although this is an open-book examination, you are not allowed to consult another
person, while the examination is in progress. You may only consult the prescribed material
for this module mentioned in the 101/3/2024 tutorial letter.
6. You must tick the Declaration of Academic Honesty. Make sure you understand what
academic dishonesty entails and are aware of Unisa’s policies in this regard. By ticking

7. Your answers must be typed in Arial 12pt and submitted online in PDF format. Create
a file in Microsoft Word and save the file as an Adobe PDF document. No other type of
submission of your examination answers will be accepted. Neither scanned typed answer
files nor handwritten scripts will be accepted.
8. E-mailed submissions or scripts from the Invigilator App will not be accepted for marking.
9. In line with the examination rules a 0% mark will be allocated for

- answers that are not typed in Arial 12pt, or
- answers that are scanned or not readable or searchable, or
- answers with manipulated text, or

10. Please note that the Invigilator App will apply during the examination. You must use the
Invigilator App for this examination. You must scan the QR code below between 14:00 and
14:45 (SAST). If you experience any technical challenges with the app between these
times, send a WhatsApp message to the technical helpdesk on 073 505 8273. Do not
contact the lecturers. Listening to audio (music) and making use of audio-to-text software
is strictly prohibited during your examination session unless such usage of the software is
related to a student’s assistive device which has been so declared. Failure to do so will be
a transgression of Unisa’s examination rules and the student's marks will be withheld.
11. The cover page to your take-home exam must include your name, student number and the
module code. Do not include anything else such as pictures or other graphics.
12. Your answers must adhere to the following:
12.1 The text must be typed in Arial font, size 12pt with single line spacing within paragraphs,
and double line spacing between paragraphs.
12.2 The text must be justified.
12.3 All pages must be numbered in the bottom right-hand corner of the page.
12.4 South African English and not American English should be used. For example, the correct
spelling is “Labour” and not “Labor”.
12.5 Do not use abbreviations or “SMS” language.
12.6 All quotes that are two lines long (or less), must form part of the main text, be written in
italics, and be bracketed by quotation marks. Where a quotation is longer than two lines, it
must be typed in a separate paragraph in italics in size 11 font and must be indented by 1
cm. No quotation marks are required when the quotations stand alone. Use quotations very
sparingly. In this take-home exam, a maximum of 5% of the text may be quoted.
13 Although this is an open-book examination, while the examination is in progress, you are
not allowed to consult another person. You may consult the prescribed material for
this module. This includes prescribed sources mentioned in the PRL5906 TL101/3/2024.
