Reasonableness is a subjective measure that determines the acceptable level of
force in any given situation. reasonableness use of force must be evaluated from
the perspective of a reasonable officer present at the time of the incident. Police
officers must make split-second decisions about the amount of force necessary to
affect a seizure, balancing the suspect's liberty against the government's interest.
The severity of the crime determines the reason for seizing someone, with arrests
and investigative detentions being traditional governmental reasons.
Reasonableness depends on the facts and immediacy of the threat.


When determining the lawfulness of the use of force in making an arrest, police officers must consider the
severity of the crime and whether it poses an imminent threat to public safety. Active resistance may also pose a
threat, but not every situation requires a split-second decision. It is the policy of the Department of Justice to
value and preserve human life. Generally, police officers are only allowed to use the minimum amount of force
necessary to protect themselves and to effectively gain control of an incident as soon as possible, while
protecting the safety of others. Law enforcement officers and correctional officers of the Department of Justice
may use deadly force only, when necessary, Officers must adhere to reasonableness standards and use physical
force only when it is legal. The use of force should be an officer's last resort. Prior to deciding whether to use
force, an officer must take into account the most crucial factors such as the severity of the offense, the potential
risk of harm to both officers and citizens, and any potential secondary risks In extreme cases, when all other
options have been exhausted, police officers may resort to physical force to restore order in the community. Free
speech is a fundamental right that is essential to the health of any democracy and a constitutionally protected
right, but it frequently conflicts with the rights of others and the need to maintain public order. Ultimately, the
right to freedom of expression must be safeguarded. The right to free speech is a major cause for concern
because individual freedom of expression frequently clashes with the rights of others. In addition, certain modes
of expression have the potential to upset the balance of power and lead to civil unrest, economic disruption, and
criminal activity. Hate speech is a form of free speech, but it can be recognized as harmful to others. It can also
have a ripple effect, which could potentially incite imminent lawlessness. It is necessary to use moderation to
