The Indian Removal Act of 1830

“The Indian Removal Act was signed into law by President Andrew Jackson on May 28,

1830, authorizing the president to grant unsettled lands west of the Mississippi in exchange for

Indian lands within existing state borders,” (Drexler, K., 2019). In this paper I will evaluate the

rationale that President Jackson used in the removal of the Native Americans from east of the

Mississippi River as well as if the removal had the intended impact, identify the responsibilities

given to the President under the Indian Removal Act of 1830, compare Jackson's actions toward

Native Americans in the context of his First Inaugural Address with the path of events during the

Trail of Tears and determine if the removal of the Native Americans from east of the Mississippi

River violate the principles found in the Declaration of Independence.

“In his first message to Congress, Jackson had proclaimed that Indian groups living

independently within states, as sovereign entities, presented a major problem for state

sovereignty,” (Corbett, 201a). When President Jackson composed that message, he was directly

referring to obstacles to white settlement posed by the Creek, Choctaw, Chickasaw, Seminole,

and Cherokee located in Georgia, Mississippi, and Alabama. These Indian groups were known to

everyone as the Five Civilized Tribes. They were known as this because they had adopted Anglo-

American culture quite largely by learning/speaking English as well as practicing Christianity.

He believed removal of the Indian groups would strengthen the frontier in the southwest which

would make the territory between Tennessee and Louisiana strong enough to repel future

invasions, if any, without the help of any remote aid.

The Cherokee Indians decided that they would fight the federal law, so they sought out

the help of the Supreme Court. Their cause had the support of the anti-Jackson Congress

members which included Henry Clay and Daniel Webster. “Wirt argued that the Cherokee
