1. The centrality of the law to a stable society or social order.
The law is very important and central to social order since it creates and
maintains peace and other in society by balancing the interest of the
individuals and those of the larger community or state. 1 It creates this social
order by establishing a set of rules which are aimed at regulating human
behavior. To ensure that these rules are followed in order to ensure peace
and stability, any person who contravenes these rules, will be charged and
tried by the state through courts on behalf of the wider community or society.
The law has for example the body of law called criminal law and civil law. 2 The
criminal law apply when someone is found to have engaged in a conduct that
disturbs or offends peace and harmony in society. This person would be said
to have done something that is forbidden (crime). For example the law forbids
an individual to kill, if one does this, they will be charged and tried, thereby
being sanctioned and punished by the state. When it comes to the importance
of law in regard the body called civil law, the law serves to maintain peace
and order by controlling the relationship between individual members of the
community or citizens as legal subjects. The law allows a person to approach
a court of law to sue a person who has tempered with their rights so as to
restore those rights.
Furthermore, South African constitution protects citizens and non-citizens,
and it guarantees that their human rights will be protected against arbitrary
violation by the state and other individuals, groups and organisations that are
powerful in various senses.3 Thus, its purpose is to create order and stability
