2.1 Constitutional and Statutory Foundation

development. Decisions affecting a sensitive wetland must therefore consider both
environmental protection and proposed economic development (LEG2601, Study
Guide, pages 31–36).

Public participation is also supported by section 2(4)(f) of NEMA, which requires that
the participation of interested and affected parties must be promoted and that people
must be given an opportunity to develop the understanding and capacity necessary
for meaningful participation. NEMA’s environmental assessment scheme
