their best interests. Section 28 directly influences how custody disputes are resolved, how children

Children’s Rights under Section 28 of the Constitution

Section 28(2) states that: “A child’s best interests are of paramount importance in every matter
concerning the child.” This clause elevates children’s rights above competing interests and creates a
