Acquiring Organisational Rights: Bakery Workers Association (BWA) vs Biscuit
Bakery (Pty) Ltd (BB)
Under the Labour Relations Act 66 of 1995 (LRA), a registered trade union such as
BWA can use several methods to acquire organisational rights in a workplace. These
rights enable the union to represent, organise and protect its members effectively.
1. Collective Agreement (s20 LRA)
Description: BWA and BB can voluntarily negotiate and sign a collective
agreement granting specific organisational rights, regardless of whether BWA is
a majority or sufficiently representative union.
Advantage: Flexible — parties can agree on rights beyond those provided in the
LRA.
Example: BB agreeing to provide BWA with access to the workplace and stop-
order facilities for subscription deductions.
2. Statutory Access Through “Sufficient Representation”
Section 12 & 13 LRA: If BWA is sufficiently representative in BB’s workplace
(often around 30% membership), it may demand:
o Access to the workplace to recruit members and communicate with
them.
o Deduction of union subscriptions from employees’ wages via stop-
orders.
Method: Written request to BB → if refused → refer the dispute to the CCMA.
