Bakery Workers Association (‘BWA’) is a registered trade union which represents
some employees within Biscuit Bakery (Pty) Ltd (‘BB’). BWA approaches BB to
acquire various organisational rights within the workplace. Describe various
methods which BWA may use to acquire organisational rights within BB. [10]
Introduction
The Labour Relations Act 66 of 1995 (LRA) provides registered trade unions with a
framework to acquire organisational rights in a workplace. The purpose of these rights is
to enable trade unions to effectively represent their members and to promote orderly
collective bargaining. As a registered trade union, BWA may rely on several methods to
secure organisational rights within BB.
Methods of Acquiring Organisational Rights
1. Collective Agreement
BWA may negotiate directly with BB and conclude a collective agreement granting
organisational rights. This method is often preferred, as it is based on mutual consent
between the employer and the union.
2. Statutory Organisational Rights (Sections 12–16 of the LRA)
Where a collective agreement cannot be reached, BWA may rely on the rights provided
in the LRA, namely:
Access to the workplace (s 12).
