Question 1

1.1 Define the parameters of the concept of “social contract”. (2)

The social contract is a theoretical framework in political and legal philosophy
that refers to an implicit or explicit agreement between individuals and the
state. Under this agreement, individuals consent to surrender some of their
freedoms and submit to the authority of the state in exchange for protection of
their remaining rights, security, and social order.

Parameters of the concept include:

 Mutual obligation: Citizens agree to follow the laws of the state, and in
return, the state ensures justice, security, and basic rights.
 Legitimacy of authority: The government's authority is derived from the
consent of the governed.
 Limitation of power: The state’s power is limited to what is necessary for
societal order, and it must act in the public’s interest.

Philosophers like Hobbes, Locke, and Rousseau each provided different
interpretations of the social contract, but they all agree that it is the foundation of a
just and organized society.

1.2 Distinguish between the following terms:

 Prosecutors and state advocates
 State attorneys and attorneys (4)

• Prosecutors and State Advocates

 Prosecutors: These are legal practitioners, usually working at the
Magistrates' Courts, who represent the State in criminal proceedings.
