Although both South Africa and Kenya have ratified international conventions and
enacted national legislation to combat human trafficking, significant implementation
gaps remain—particularly in safeguarding the constitutional rights of child victims. The
increasing visibility of children engaged in forced begging, often alongside adults in
metropolitan areas, raises serious concerns regarding their exploitation and the
effectiveness of current legal interventions. This research seeks to explore whether the
existing legal frameworks in South Africa and Kenya adequately address the specific
vulnerabilities of children trafficked for exploitative purposes and whether these
frameworks are enforced in a manner consistent with constitutional and international
human rights obligations.
4. Research Objectives
The primary objectives of this study are:
To critically examine and compare the anti-human trafficking laws of South Africa
and Kenya, with a focus on children trafficked for forced begging.
To assess how these legal frameworks uphold the constitutional rights of child
victims.
To evaluate the implementation and enforcement mechanisms in both countries.
To identify best practices and legal gaps that hinder effective protection and
prosecution.
To propose recommendations for strengthening the legal and institutional
responses to child trafficking in both jurisdictions.
