The debt is secured by a mortgage bond registered over the hotel. A guest of the hotel, Annie, accidentally packed a towel that looked like her own into her suitcase, honestly believing that it was hers, before leaving the hotel. One of the hotel’s chefs, Sipho, asked Thandi whether he could rent one of the small rooms in the hotel for a period of six months. Thandi agreed, and they concluded a lease agreement. Sipho also asked Thandi to borrow R5 000. They agreed that Sipho would pledge his cell phone as security for the loan. Thandi paid the R5 000 into Sipho’s bank account, but both parties agreed that it would not make sense for Sipho to hand the cell phone to Thandi. Thandi stated that she 6 trusted Sipho and believed that he would repay the money. A serious dispute later arose between Thandi and Sipho, and their relationship deteriorated. Sipho took a few days’ leave. While Sipho was away, Thandi changed the lock of Sipho’s room, removed his belongings and placed them in a storeroom. When Sipho returned, he discovered he could not access his room. He became extremely angry and set Thandi’s car on fire. He then broke into the storeroom and the room he had rented from Thandi, damaging the locks and doors of both rooms in the process. Sipho also kicked one of the fridges Thandi had purchased from Value Save Traders (Pty) Ltd, damaging it severely. Thandi contacted the private security company responsible for the hotel's security. Sipho later approached his friend, Daniel, a law student, for advice. Daniel advised Sipho to institute rei vindicatio against Thandi to recover his belongings and the control he previously exercised over the rented room.
