2. Relevant Provisions of South African Labour Legislation:
o Labour Relations Act (LRA), 1995:

Employment and Labour can extend the terms of

been registered with the Bargaining Council.
 Section 23: Deals with the recognition of trade
unions and employer organizations, and can
relate to the scope of agreements.
 Section 51: Pertains to the registration of trade
unions and employer organizations and can
affect the enforceability of collective
agreements.
3. Discussion of Provisions:
o Extension Mechanism: The LRA allows for the
extension of agreements to non-parties to ensure
uniformity and fairness in working conditions across
an industry. This is meant to prevent employers from
gaining a competitive advantage by opting out of
collective agreements that set minimum standards.
