PREVIEW

(a)

An ordinary application is typically used when there are no material disputes of fact
and the matter can be decided on affidavits. However, in a breach of contract case,
especially one involving a claim for a substantial amount like R600,000, there are
likely to be material disputes of fact that require oral evidence and cross-examination.
Therefore, X should institute proceedings by way of action (summons), which is the
appropriate procedure for such matters where factual disputes are anticipated.
