Facts of the court
On 31 July 2019, the respondent launched an application seeking various relief
against the Public Protector, including reviewing and setting aside findings and
remedial actions the Public Protector took in a report she rendered against the
respondent. The Speaker of the National Assembly and the National Director of
Public Prosecutions joined in the review application, while the Public Protector and
the Economic Freedom Fighters opposed the relief sought in the review application.

On 6 November 2019, amaBhungane applied to intervene as a party or be admitted
as amicus curiae in the litigation proceedings between the respondent and the Public
Protector.The President promulgated the Ethics Code in terms of section 2(1)2 of the
Members’ Act. The Code governs all national Ministers, all national Deputy Ministers
and all provincial Members of the Executive Councils.
