The author addresses the concept of Ubuntu. Ubuntu emphasis a notion of social
harmony, love, togetherness and tolerance.1 It “defines the nature of relationships
among Africans. It highlights the significance of being humane in Africa. It shows how
humanism encompasses a strong consideration of the other through whom one
defines oneself”.2
Ubuntu forms part of South African legal system.3
“The Constitution carries within itself the spirit of ubuntu”. Ubuntu is recognised in the
Constitution by a mere recognition of the fundamental right in Chapter 2. The current
constitution is a transformative one. Its transformative objectives are a way of carrying
ubuntu forward.4 In summary, the fact that the Constitution does not mention ubuntu
specifically does not mean that this notion is discarded in the supreme law of the land. 5
Ubuntu is a “valuable”6 source of law.7 Ubuntu has no prescription.8
