In April 2016, the African Union Peace and Security Council (PSC) received the
final report of the fact-finding mission of the African Commission on Human
and Peoples’ Rights to Burundi. The report highlighted that:
“Government security personnel and affiliated groups perpetrated wide range
of violations. Not only that these violations were perpetrated repeatedly but
also they overtime have become part and parcel of the response of security
forces to the violent expressions of opposition to the government. The
violations have thus been pervasive and systematic”.
On the basis of this report, the PSC recommended the deployment of 5,000
peacekeeping troops to Burundi, a plan that was later rejected by the African
Union Assembly.
Based on the scenario above, answer the following questions:
a) In terms of Article 4 (h) of the African Union Constitutive Act, list and briefly
explain the grounds for intervention in the affairs of its member states. [10]
b) If you agree that the AU can intervene through the use of force, discuss
whether such intervention requires Security Council authorisation. [10]
c) Provide an opinion on the importance of AU intervention in Burundi. [5]
