Introduction

The South African constitutional system is characterised by a distinctive approach to
governance in which national, provincial and local government operate as separate but
interconnected spheres. Rather than establishing a rigid hierarchy in which one sphere
exercises unrestricted authority over the others, the Constitution of the Republic of South
Africa, 1996 recognises these spheres as “distinctive, interdependent and interrelated”
(Constitution of the Republic of South Africa, 1996, s 40(1)). This constitutional
arrangement reflects the reality that effective governance and public service delivery
require institutions across government to work collectively towards common national
objectives.

Intergovernmental cooperation is therefore a fundamental component of South Africa's
constitutional democracy. Section 41 of the Constitution establishes principles that require
the different spheres of government to respect one another's constitutional authority, act in
good faith, consult with one another, exchange information, coordinate their policies and
programmes, provide assistance and support, and resolve disputes through appropriate
mechanisms (Constitution of the Republic of South Africa, 1996, s 41). These requirements
seek to ensure that the division of governmental responsibilities does not result in
fragmentation or institutional competition that ultimately disadvantages citizens.

The significance of cooperative government is particularly evident in public service delivery.
Services such as housing, healthcare, education, water, sanitation, electricity and
infrastructure frequently require the participation of more than one sphere of government.
National government may formulate policy and allocate resources, provincial government
may be responsible for implementation and oversight, while municipalities often have direct
responsibility for delivering services to communities. Consequently, inadequate cooperation
can lead to overlapping responsibilities, inconsistent policies, inefficient use of resources
and delays in service delivery.
