ASSIGNMENT 2 SEMESTER 1
APRIL 2026

Question 1

a.

Prosecutorial bail may be considered for the release of Allan Fuse, but its application
in this instance is limited. Prosecutorial bail, as regulated by section 59 of the
Criminal Procedure Act 51 of 1977, allows a prosecutor to authorise bail for an
accused who has been arrested for a Schedule 7 offence before the accused
appears in court1. Arson, particularly where extensive property damage occurred in a
central business district, is a serious offence and may be treated as a Schedule 5
offence depending on the circumstances and potential sentence 2. Schedule 5
offences fall outside the scope of prosecutorial bail, which means that only a court
may grant bail in such cases.

Furthermore, prosecutorial bail is generally reserved for less serious offences where
there is minimal risk of flight, interference with witnesses, or danger to the public 3.
Given that Mr Fuse was allegedly seen by witnesses committing the offence and that
the damage was extensive, the likelihood of opposition to bail is high. Accordingly,
prosecutorial bail would not be appropriate in this instance, and Mr Fuse would need
to apply for bail in court.
