Question 1

With specific reference to section 13(1) of the Interpretation Act 33 of 1957, the
terms “adoption” and “commencement” relate to important stages in the life
cycle of legislation.

The term adoption refers to the stage in the legislative process where a proposed
law (a Bill) has been formally approved by the relevant legislative authority, such
as Parliament. During the legislative process, a Bill is introduced, debated, and
possibly amended before it is finally voted on. Once the majority of members of
the legislative body vote in favour of the Bill, it is regarded as having been
adopted. Adoption therefore signifies the legislature’s formal acceptance of the
Bill as legislation. However, adoption does not necessarily mean that the law is
immediately in force. After adoption, additional formal steps may still need to
occur, such as the signing of the Bill by the President and its publication in the
Government Gazette.

The term commencement refers to the moment when legislation comes into
operation and becomes legally binding and enforceable. In terms of section 13(1)
of the Interpretation Act, where an Act does not specify a particular date for its
operation, it is presumed to commence on the date on which it is published in the
Government Gazette. From that date onward, the provisions of the Act have full
legal effect and may be applied by courts, government institutions, and
individuals. Commencement is therefore the point at which the adopted
legislation begins to function as law.

In summary, adoption refers to the formal approval of a Bill by the legislature,
while commencement refers to the stage at which the legislation officially comes
into force and begins to have legal effect. These two concepts are distinct
because legislation can be adopted before it actually begins to operate as law.
