Question 1

An ante-nuptial contract is a written agreement entered into by two
parties before the marriage is solemnised in order to regulate the
matrimonial property system that will apply to their marriage. The
contract is executed before a notary public and must be registered in
the deeds registry within three months of its execution to be valid
against third parties. The purpose of an ante-nuptial contract is mainly
to exclude the automatic matrimonial property system of community of
property and community of profit and loss. Through this agreement,
the parties determine in advance how their assets, liabilities, and
financial affairs will be managed during the marriage and how they will
be divided if the marriage ends.

A post-nuptial contract, on the other hand, is a matrimonial property
agreement that is entered into after the marriage has already taken
place. This situation usually occurs when spouses intended to marry out
of community of property but failed to conclude an ante-nuptial
contract before the marriage. Because the marriage automatically
becomes one in community of property in the absence of such a
contract, the spouses must apply to the High Court for permission to
change their matrimonial property system and to register a post-nuptial
contract. The court will grant this order only if it is satisfied that the
spouses had originally agreed to marry out of community of property
and that the rights of creditors will not be prejudiced.
