Advice on access to the african commission on human and peoples’ rights: the
case of mr ricardor and the people of magadi



1. Introduction

Human rights protection in Africa is founded on both international and regional
legal systems that aim to promote dignity, equality, and social justice. States that
ratify international and regional human rights instruments undertake obligations
to respect, protect, promote, and fulfil the rights of individuals within their
jurisdictions.

The Republic of Sofala has ratified several important human rights instruments,
including the African Charter on Human and Peoples’ Rights and the Protocol
establishing the African Court. However, despite these commitments, the people
of Magadi continue to live in extreme poverty and deprivation, with no access to
basic services such as clean water, education, healthcare, or infrastructure.

Mr Martin Ricardor has unsuccessfully pursued domestic remedies for more than
ten years, including litigation before the Constitutional Court. A regional NGO,
Developed Afrika for All (DAA), now seeks to approach the African Commission
on Human and Peoples’ Rights on his behalf.

This assignment critically examines whether DAA can bring the case before the
African Commission. It analyses the procedural requirements, the substantive
rights potentially violated, the limitations of the system, and the possible
remedies available.
