1. The offences were allegedly committed in Cape Town. However, A was arrested in Pretoria.
Due to the nature and seriousness of the alleged offences, the National Director of Public
Prosecutions (NDPP) decides that A should first appear in the Supreme Court of Appeal (SCA),
where the trial will also be conducted. Critically discuss the efficacy of this decision.

The decision by the National Director of Public Prosecutions (NDPP) to have A appear in the
Supreme Court of Appeal (SCA) instead of a lower court might be criticized due to its potential
inefficiency and complications in the criminal procedure. Normally, a trial for alleged offences
would take place in a court with appropriate jurisdiction, often within the area where the offences
occurred, in this case, Cape Town.

By moving the trial to the SCA, there are logistical concerns such as travel, cost, and unnecessary
delay. Additionally, since the SCA primarily handles appeals, its involvement in a trial could be seen
as an inappropriate use of resources. It could also undermine the fairness of the proceedings if the
accused is not tried in the jurisdiction where the crime occurred (CPR3701 Study Guide, page 120).

2. A is arrested at his house by Sergeant D and subsequently incarcerated at the police station.
A sues the Minister of Police for the arrest. In the court papers, A argues that the “arrest was
not necessary”, and that a different method of bringing him before court, namely, a summons,
should have been applied. Critically evaluate A’s argument.

A’s argument that the arrest was unnecessary and that a summons should have been issued instead
revolves around the proportionality and necessity of the police action. Arrests are generally
permitted when a person is suspected of committing a serious crime or when it is necessary to ensure
their appearance in court.

However, a summons is often used for less serious offences where the individual is not considered a
flight risk or a danger to the public. In this case, A’s argument may be valid if the arrest was made
without reasonable suspicion of immediate danger or a threat of evasion. Courts often require a more
stringent justification for arrest compared to a summons, and thus A’s challenge might be successful
if the arrest was indeed disproportionate (CPR3701 Study Guide, page 115).
