Introduction
South Africa’s transition from apartheid to constitutional
democracy in the early 1990s is widely regarded as one of
the most remarkable political settlements of the twentieth
century. Leaders representing ideologically divergent
political movements—FW de Klerk of the National Party (NP),
Nelson Mandela of the African National Congress (ANC), and
Mangosuthu Buthelezi of the Inkatha Freedom Party (IFP)—
played a decisive role in steering the country toward
democratic governance. Their cooperation laid the
foundation for a constitutional order based on supremacy of
the Constitution, the rule of law, and a multi-party system of
democratic government. Section 1(d) of the Constitution of
the Republic of South Africa, 1996 entrenches these values
by affirming regular elections and a multi-party system to

However, sustaining democracy is a continuous and
demanding process. As the Constitutional Court has
repeatedly emphasized, democracy is not merely about
elections but about institutions, practices, and a political
