1. Summary of the Facts
Cashbuild SA Ltd dismissed Ms Lorraine Tsiri, a system supervisor, for gross negligence
after she authorised payment of R2 847.14 instead of R2 482.00 from petty cash on 8 July
2022.1 At the time of dismissal, Ms Tsiri was already subject to a final written warning for a
similar offence. Following her dismissal, the matter was referred to the CCMA, where the
commissioner found the dismissal to be substantively unfair and ordered reinstatement.1
