Both statements from the American Psychiatric Association and the Mental Health
America focus on risk prevention, the importance of assessment and monitoring,
and the involvement of legal processes. They both state that when the risk of harm
is present to an individual or others, involuntary treatment should be considered
while also making sure that there is a thorough clinical assessment and ongoing
monitoring which ensures that the decision is based on objective, clinical evidence
rather than assumptions or biases. Legal and judicial processes should also be
used to ensure that involuntary treatments are made fairly and justly to try and
balance autonomy in those that need intervention in cases of severe mental illness.

These statements differ in that the APA’s stance seems to lean more towards the
psychiatrist’s clinical judgement deeming that it is necessary for involuntary
treatment in cases of severe disability or imminent danger. The MHA’s stance
places a stronger emphasis on an individual’s rights and to be more cautious about
potentially violating a person’s autonomy and advocating for alternatives with less
restrictive treatments.

The Nevada Revised Statutes (NRS) Chapter 433 is what dictates the criteria for
involuntary commitments. A person must be a danger to themselves or others due
to their mental illness, they are unable to provide for their basic needs due to
mental illness, and the need for mental health treatment that cannot be effectively
provided on an outpatient basis. Here, it appears that there is an emphasis on the
importance of clinical evaluation and risk assessment. It should be used as a last
resort and only used when someone’s condition is severe enough to warrant such a
measure (State of Nevada, 2025).

After reading the position statements, with which statement do you find
yourself more philosophically aligned? Explain why.
Personally, I find myself more philosophically aligned with Mental Health
America's position, particularly their focus on prevention and community-based
mental health services. The emphasis on less restrictive alternatives and
empowering individuals to make decisions about their treatment resonates more
with my view on mental health care, which centers on autonomy and reducing
coercion. MHA’s standpoint also acknowledges the inherent dignity of individuals
and the need to ensure that mental health services are accessible and equitable,
which I believe is crucial for reducing the need for involuntary treatment (State of
Nevada, 2025).
