Introduction

Employment laws are there to protect the interest and rights of employees. Every country has its
employment laws that have been evolving. Some of these employment laws are different for
different countries. Consequently, global firms should investigate the employment laws of the
country they want to expand to before making decisions.

The laws regarding hiring, firing, diversity, paid leaves, and labor unions differ based on the
country of operation. Companies need to evaluate the opportunity and risks as they branch out
into new territories. In this paper, I'll present the difference in maternity leave between Ethiopia
and U.S.

Maternity Leave in Ethiopia

According to Ethiopian Labor law, women get 120 days of paid maternity leave for civil service
and in the private sector (Proclamation №1064/2017 § 42(3) &(10)). Furthermore, based on the
revised labor law fathers can get 10 days if in civil service and 3 days if in the private sector
(Proclamation №1064/2017 § 81(2)). The law made it clear that the primary caregiver for the
newborn child is the mother and the father is supposed to assist the mother as seen in the number
of paid leaves given.

As mentioned above, the law provides the mother with maternity leave with full pay as supported
by the Constitution of Ethiopia. Furthermore, it provides a general outline regarding the nature of
work that a pregnant employee is not permitted to perform so as not to endanger her or the
child's health (Article 87 (2) to (6)). These include overtime work, night work, or work in areas
that are difficult to move.

Additionally, the law gives pregnant women time off for medical examinations before the birth
of the child (Article 88 (1)). This leave is also a paid leave and employers need to obey unless

, there's a protracted medical condition that will prohibit the women from attending work for an
extended period.

The maternity leave shall start 30 days before the due date of the birth, as per the doctor's
instructions, and end not less than 60 days after the birth of the child. These would constitute
around 4 months of paid maternity leave. However, the mother could extend the last month of
her maternity leave by coming to the office for half-days. This will help her extend maternity
leave to over 140 days while helping her transition into office smoothly.

The only condition for a woman to take maternity leave is that she has to be a permanent
employee. The probation period for temporary employees to become permanent is 90 days. After
that, she's entitled to take maternity leave as per the labor law discussed above. The Federal
Proclamation №1064/2017 § 42 provides additional grants concerning maternity leave as
presented below.

If the pregnant employee delivers before her presumed due date, the number of days taken before
delivery will be moved forward for her to use. on the contrary, if the pregnant employee doesn't
deliver on the presumed date, the days she took before her confinement shall be replaced by
annual leave. The number of days will be based on the annual leave left in that budget year and if
there's not based on the following budget year.

However, if she encounters a miscarriage after six months of pregnancy and she can bring a
medical certificate to confirm it she is entitled to 60 days post confinement maternity leave. But
if the miscarriage happens during delivery she is entitled to 90 days of post confinement
maternity level. Finally, if the miscarriage happens before or up to three to six months of the
pregnancy she'll be granted 30 consecutive days of leave with pay.

The Ethiopian labor law is very generous in this regard and is very different from the labor law
in U.S. Companies need to have an HR department that's knowledgeable about these laws to
avoid any legal cases and be prepared to work smoothly.
