The two main Acts of legislation applicable when dealing with
human trafficking in South Africa are:


1. The Prevention and Combating of Trafficking in Persons Act
7 of 2013 (PACOTIP Act)
This is the most comprehensive piece of legislation in South Africa
dealing specifically with human trafficking. It was signed into law
to give effect to South Africa’s obligations under international
conventions such as the United Nations Protocol to Prevent,
Suppress and Punish Trafficking in Persons, especially Women
and Children (Palermo Protocol).
Key Features and Provisions:
 Comprehensive definition of trafficking in persons: The Act
provides a wide definition of trafficking that includes
recruitment, transportation, transfer, harbouring or receipt of
persons through threats, force, coercion, abduction, fraud,
deception, abuse of power, or giving and receiving of
payments to achieve the consent of a person having control
over another.
 Criminalisation: It criminalises all forms of human
trafficking, including trafficking for sexual exploitation, forced
labour, slavery, servitude, and the removal of body parts.
