Private Defense
Private defense is a ground of justification in criminal law that allows a
person, including a security official, to use force to protect themselves,
another person, or property against an unlawful attack. A security
official may invoke private defense if:
1. There is an unlawful attack directed at themselves, another
person, or property.
2. The attack is imminent or has already begun (not in the distant
future or past).
3. The defensive act is necessary to avert the attack.
4. The means of defense used are reasonable and proportional to
the nature of the attack.
Example:
If an armed robber attempts to stab a security official during a cash-in-
transit robbery, the official may lawfully shoot the attacker to protect his
own life.
