Section 16 of the Deeds Registries Act 47 of 1937 stipulates that transfer of land must be effected by registration in a deeds registry, and Regulation 18 sets requirements for the proper description of transferees (including natural persons, legal persons, partnerships, and trusts). Below are examples of vesting clauses for the three specified scenarios: (a) A partnership where at least one of the partners is married in community of property When a property is transferred to a partnership, all partners must be named, and the marital status of each individual must be stated. If a partner is married in community of property, the spouse’s details must be included because the spouse automatically has an undivided half-share in the partner’s estate (unless excluded by law).
