While reading the Study Units, focus on the nature of the different rights that are dealt with in
this module, namely personal rights, real rights, and limited real rights (Study Unit 2). Keep in
mind that ownership is the most complete real right that a person can have regarding his or her
own thing, but the law and the rights of others can limit this right (Study Unit 2). Ownership
confers a real right on an owner. Ownership can be acquired in different ways, either through
original means or through derivative means (Study Units 4 and 5).
Months go by and despite Karen regularly trying to communicate with Lerato on WhatsApp,
Lerato seldomly responds. Karen is sad and misses Lerato. One afternoon after taking a walk,
one of Karen’s new neighbours comes over for coffee. During their discussion, Karen mentions
that she owns the Mercedes and the townhouse. Examine the correctness of Karen’s statement.

1. Ownership as a Real Right
Real Rights
Ownership is the most comprehensive real right that a person can have over an object or
property. It gives the owner the right to use, enjoy, and dispose of the property, subject to legal
restrictions and the rights of others.
Study Unit 2 discusses real rights, emphasizing that ownership is a real right. But, this right is
not absolute and can be limited by law or the rights of others.
