Deferred Adjudication- the defendant pleads guilty to, or is found guilty of, certain offenses minimum or maximum term for CS depends upon the offense of conviction, the date the offense was committed and the type of supervision granted. 3- Right to bail pending a motion to revoke- RC defendant has been convicted it is discretionary with the judge as to whether to allow bail pending a motion to revoke, Felony Deferred Adjudication has not been convicted so the judge must set bail. 4- Eligibility for early discharge from CS. RC defendant is eligible for early termination after he has served 1/3 of his term, or 2 years whichever is less, Deferred Adjudications are eligible for early discharge immediately upon sentencing 5- Eligibility for CS later - RC for a felony offense in the past counts as a conviction and the jury cannot grant community supervision. Deferred Adjudication before does not count as a conviction and the jury can gran CS, under certain circumstances the judge can grant regular CS even thought the defendant has a prior felony conviction. 6- Confinement as a condition of community supervision- For both a judge can order a probationer to confinement for up to 180 days as a condition of community supervision. With regular CS and under certain circumstances the judge Must require a defendant to submit to confinement. 7- Sentence upon revocation- RC supervision the sentence cannot be longer than the punishment originally assessed.
