Statewide Contract Development Section of SPD with authority to develop and manage statewide term contracts for use by state agencies, higher ed, and local government. Contract Advisory Team - Review and Delegation (CAT-RAD) Program or Procurement Oversight & Delegation (POD) Section of SPD that conducts solicitation review and delegation of purchasing authority for state agencies' service contracts $100k+, made up of internal personnel. If their review lasts longer than 30 days, the agency still does not have authority to post the solicitation until they hear back. This entity escalates solicitations worth $5M+ to CAT. Contract Advisory Team (CAT) Section of SPD that reviews solicitations worth $5M+ and consists of representatives from multiple agencies. Quality Assurance Team (QAT) Made up of representatives from multiple agencies. Reviews MIRP solicitations $1M - $5M. The solicitations are still uploaded through the CAT-RAD portal, who escalates to this entity. Historically Underutilized Business (HUB) Program Section of SPD that promotes full and equal business opportunities in an effort to remedy disparity in state procurement and contracting. State agencies and higher ed must submit semiannual reports in which they demonstrate a good faith effort to assist these companies in receiving a portion of the total contract values awarded. HUBs are listed on the CMBL. Subcontracting is probable at $100k+. Centralized Master Bidder's List (CMBL) Section of SPD that is a master database that fosters competition between vendors. Vendors are not required to be on the this to do business with the State of Texas. When searching the this, you can filter for HUBs. $5k+ solicit from 3 CMBL vendors, 2 of which HUBs. $25k+ all CMBL. Electronic State Business Daily (ESBD) Application in SPD web portal used for posting notice of opportunities, solicitations, and contract award notices for commodities and services contracts with values over $25k. This threshold applies without regard to the source of funds used for the contract. Contract value includes the initial period and all renewal/extension options. Contract may be void if not posted to ESBD properly. Entire solicitation has to be published to ESBD for X calendar days or notice of the solicitation must be posted for Y calendar days with instructions for accessing the solicitation. X = 14, Y = 21 Notice of the solicitation must be posted for X calendar days with instructions for accessing the solicitation. 21 Addenda needed to clarify information must also be posted for X days. 21 Texas SmartBuy Online Ordering System Search statewide term contracts (procured and managed by SPD) for items required. The majority of purchases from SPD contracts require a PO through this. State agencies without delegated purchasing authority must purchase from SPD contracts. Local (non-state) who want to purchase off SPD contracts must purchase membership. Lists: TXMAS contracts (POs must be issued through this), Products/services from TCI and TIBH, Statewide term contracts, Managed contracts but purchases cannot be made through this. Texas Multiple Award Schedule (TXMAS) Program: To supplement SPD's statewide term contracts, SPD adapts existing competitively awarded government contracts to the procurement needs of the state of Texas (except consulting/architectural/engineering contracts) by overlaying SPD's standard contract terms over the base contract. Prior to purchasing from these contracts, state agencies must follow the best value determination and applicable statutes and purchase from TIBH, TCI, and SPD term contracts first (N/A to local governments/higher ed). $0 - $50k (TXMAS) May purchase directly from TXMAS vendor $50k - $1M (IT commodities) For IT commodities, must obtain price quote from three (3) relevant TXMAS vendors or DIR's cooperative contracts list. Orders from TXMAS contracts exceeding $25k must... ...be posted to ESBD. Vendor Performance Tracking System (VPTS) Section of SPD that collects reports from state agencies for contracts $25k+. The program maintains a system for scoring vendors (A, B, C, D, F) and supplies that information to state agencies to reduce risk in the contract award process. Dollar threshold at which VPTS reports required $25k+ Office of Vehicle Fleet Management (OVFM) Section of SPD that assists state agencies and higher ed with the management of their fleet vehicles as well as with reporting their fleet vehicles in the state's reporting system (TXFS). Executes interagency contracts for vehicle maintenance and repair services. State Travel Management Program (STMP) A section of SPD. Provides contract travel services to state agencies, higher ed, and travel-eligible SmartBuy members (including local governments, public school districts, and community colleges). These contracts include credit cards, travel agents, hotels, car rentals, and airlines and help the state manage and reduce travel expenditures and monitor travel activity. Statewide Mail Operations (SMO) A section of SPD. Provides state agencies and higher ed delivery and collection of USPS mail, interagency mail, and state warrants at a reduced rate - NOT FREE. Interagency mail services (Travis county only) saves the state money on USPS postage costs. Reviews/approves agency requests to purchase, lease and service mail equipment. Provides outgoing mail information, provides guidelines for mail handling, and serves as the USPS liaison. Procurement Plans Due on November 30th every year to the CPA. SPD collects them to determine if there are possible gains if purchases are consolidated and how many employees need certification from SPD. Clear Specifications Easy to understand, specific. Allows agencies to hold vendors to deliverables/requirements. Restrictive Specifications Can reduce competition. Market research should be done in advance. Can appear to be tailored to specific vendor. Request for Information (RFI) Optional planning tool used to gather information. Not a procurement method and cannot result in contract award. Request for Applications (RFA) Not approved for procuring goods/services, used for grant applications tied to designated funds. Interagency Cooperation Agreements (IAC) When one agency procures goods/services from another and a competitive procurement process is not required. The agencies must certify that the services are necessary, serve the best interest of the agencies, are not required to go to the lowest bidder, neither party is exceeding its duties. Warranty Promise made by a seller to a buyer that is legally enforceable. Maintenance Agreement Must be included in solicitations for heavy equipment, IT commodities, and other machinery. Remedies Contract provisions that provide protection to the contracting agency and can be in the form of damages. Texas Register Solicitations for major consulting services must be published here for at least 30 days prior to executing the contract. $15k+ for state agency, $25k+ for higher ed. If $25k+, must also be posted to ESBD or is void. $25k+ threshold All relevant CMBL vendors must be solicited.
