Intention to create legal
relations
By Taonga Kanyimbo
, Introduction
Very often in life people make agreements without any intention to be legally
bound (give simple e.g)
Cases on intent to be legally bound generally fall in two groups; those domestic
and social agreements (family, friends etc.) and the other, commercial transactions
( companies etc).
With domestic agreements, the courts will presume there is no intention to be
legally bound, but this can be rebutted if there’s evidence against this. The reverse
is taken with commercial transactions.
