1. Introduction

Sentencing is an important component of the South African criminal justice system
because it determines the nature and extent of the punishment imposed on a person
who has been convicted of an offence. A sentencing court is required to balance several
competing interests. On the one hand, the seriousness of the offence and the interests
of society must be recognised. On the other hand, the personal circumstances of the
offender, the possibility of rehabilitation and the circumstances surrounding the
commission of the offence must also be considered. Sentencing is therefore not simply
a matter of imposing the harshest possible punishment. It involves the exercise of
judicial discretion within the framework of established principles of South African
sentencing law.

The case of Sipho N. illustrates the difficulties involved in achieving an appropriate
balance between these considerations. Sipho was a 19-year-old first offender who
pleaded guilty to housebreaking with intent to steal and theft after stealing electronic
equipment worth approximately R15 000. Although there were aggravating
circumstances, there were also significant mitigating circumstances, including his young
age, lack of a criminal record, guilty plea, remorse, unemployment, homelessness and
willingness to undergo rehabilitation. A criminologist's pre-sentencing report
recommended correctional supervision or another non-custodial sentence.

deterrence and the prevalence of property crime.

This discussion examines the concept of judicial discretion, the traditional triad of Zinn

in Sipho's case, considers the four major aims of punishment—retribution, deterrence,
rehabilitation and incapacitation—and identifies the aims apparently prioritised by the
court. The discussion further considers how overcrowding, underfunding and limited
