PVL2601 Assignment 1 Semester 2 2026 - Due 7 September 2026 PVL2601 Assignment 2: Semester 2 Question 1 Mr Xitsonga, a Tsonga man, entered into an unregistered customary marriage with his wife on 13 March 1999. In December 2022, Mrs Xitsonga learnt that her husband had paid lobolo for Ms Ntswaki and that they had celebrated a traditional wedding. In January 2023, Mr Xitsonga and Ms Ntswaki went to the offices of the Department of Home Affairs, and they entered into a civil marriage. Mrs Xitsonga approaches you and requests information about the following: Answer the following questions: (a) Is her customary marriage legally recognised and, if yes, which Act regulates her marriage? (2) (b) Is the customary marriage between Mr Xitsonga and Ms Ntswaki legally recognised? Provide reasons for your answer. (6) (c) Is the civil marriage between Mr Xitsonga and Ms Ntswaki legally recognised? Provide reasons for your answer. (2) [10] Question 2 Mr and Mrs Simpson married out of community of property without the accrual system in 2010. It was Mrs Simpson’s first marriage and Mr Simpson’s second marriage. Mr Simpson was 45 years old when she married Mr Simpson, who was 65 years old at the time. Mrs Simpson never worked during the marriage, as Mr Simpson believed that a woman’s place is in the home. After 15 years of marriage, Mr Simpson died and bequeathed the whole of his estate to his three children from his previous marriage. Mrs Simpson has no assets or income of her own but does not want to claim redistribution of assets from Mr Simpson’s estate.
