1.1 Dealing with the Mortgage Bond over Erf 3
Under Section 40(5) of the Deeds Registries Act 47 of 1937, a Certificate of Consolidated Title cannot be
registered if one of the component properties (Erf 3) is hypothecated under a mortgage bond, unless
the bondholder (Blue Bank) consents. Sarah and Steven must address this by obtaining the written
consent of Blue Bank to either:
Extend the bond to cover the entire newly consolidated property (Erf 5) [Section 40(5)(a)], or
Cancel the existing bond over Erf 3 entirely, or

2. Extending Clauses for Unregistered Land
2.1 First Deed of Transfer
In the first deed of transfer for a new piece of land that has never been registered before, there is no
prior holding title deed. The clause will read: [1]

thereto.”
2.2 Second Deed of Transfer [1, 2]
In the subsequent (second) deed of transfer, the clause must reference the holding deed that was
created during the first registration:
