• A tort is a civil wrong against a person or property such as restraining or
medicating a patient against his or her wishes.

• Criteria for malpractice include the following: the nurse owed a duty to the
patient, the nurse did not carry out that duty, the patient was injured, and the
injury was caused by the nurse's failure to carry out that duty.

• Nursing students are held to the same standard of care as are licensed nurses.

• An LVN/LPN who makes assignments or delegates tasks to other providers is
