ASSIGNMENT 1
DUE DATE: 12 MARCH 2026

,OVM2602 ASSIGNMENT 1 2026

DUE 12 MARCH 2026

QUESTION 1

1.1 Study this image and identify the crime that was committed. Supply the
reason(s) for identifying this specific crime. (5)

The image depicts an individual forcibly opening a window to gain access to a residential
dwelling. The crime being committed is housebreaking (Study Guide OVM2602, Unit 3,
p. 38).

I reached this conclusion by examining the essential components of the offence. The
person's actions are clearly unlawful as there is no indication of permission from the
property owner. The physical act of forcing the window open satisfies the requirement of
breaking, which involves overcoming any obstacle that blocks entry. So inserting a hand
or body through the opening, the individual completes the act of entering a structure.
Since the target is a home, it qualifies as a building or structure intended for human
habitation, further confirming that housebreaking has occurred.

1.2 Define the crime you identified in question 1.1.

Housebreaking, when accompanied by the intention to commit an offence, refers to the
act of unlawfully and deliberately forcing one's way into and entering a premises, such
as the home shown in the image, with the purpose of carrying out a crime once inside

, (Study Guide OVM2602, Unit 3, p. 38). As theft is the most frequent objective, the
intention could also involve other offences like assault or malicious damage to property.

QUESTION 2

2.1 Study this image and indicate the reasons why a housebreaker would choose
this property to commit the crime which you have identified in question 1.1

Several observable factors make this particular property an appealing target for a
housebreaker (Study Guide OVM2602, Unit 3, p. 40):

Neglected landscaping: The tall grass and overgrown vegetation suggest that the
residents may be away or do not maintain the property regularly, signaling a low-risk
opportunity.

Accumulated mail and newspapers: A postbox overflowing with uncollected items is
a well-known indicator that the occupants are absent, possibly for an extended period.

An accessible garage: An open garage, particularly if it appears empty, suggests that
no one is present and may also contain valuable tools or provide another entry point.

Overall neglected appearance: The combination of an untidy yard and uncollected
mail creates an impression of vacancy or inattentive residents, making the property
more attractive to an offender seeking to avoid detection.
