• Sources of Law: common law, statute law and equity
• The supremacy of the Constitution is a fundamental principle of Canadian law
i.e., all laws must comply with the constitution.
− The Constitution Act, 1982 includes the Canadian Charter of Rights and
Freedoms (between government and individuals) i.e., the Charter does not
apply to business transactions
▪ Example: If you think a government action or law discriminates you because of
your gender
• The Supreme Court of Canada’s decisions are binding on all courts in Canada.
• Stare Decisis (doctrine of precedent)
− Judicial hierarchy?
− Similar facts?
