forwarded. Answer: Within seven calendar days of receipt of the Form
22, the supervisor shall:


(1) Indicate a decision or action on the form.
(2) Sign and date the form.
(3) Ensure a copy is made and retained in the facility
(4) Return the original to the inmate or parolee.


⩥ What are the time constraints of a CDCR Form 22. Answer: Within
three working days after receipt of the form, the responding employee
shall:


(A) Note his or her decision or action on the form.
(B) Sign and date the form.
(C) Retain a copy for his or her records.
(D) Return the original and remaining copy of theform to the inmate.

,⩥ What constitutes abuse of the 602 appeal system. Answer: A
submission of more than one appeal every 14 calendar days. This also
includes group appeals.


The repeated filing of appeals that have been cancelled pursuant to
3084.6(c).


The appeal contains threatening, grossly derogatory, or obscene
statements.


This does not include an emergency appeal.


⩥ What happens when a 602 appeal describes staff behavior that could
be considered misconduct?. Answer: An inmate alleging staff

hiring authority, it will be processed as a staff complaint. If the hiring
authority makes a determination that the complaint shall not be accepted
as a staff complaint, it shall be processed as a routine appeal. All appeals
alleging staff misconduct will be presented by the appeals coordinator to
the hiring authority or designee within five working days.

CDCR Form 602-A Inmate Appeal Form Attachment shall be used if
additional space is needed to describe the issue under appeal or the relief
requested.

Answer: A second level review shall be conducted by the hiring
authority or designee at a level no lower than Chief Deputy Warden, or
the equivalent.

Answer: The third level review constitutes the decision of the Secretary
of the California Department of Corrections and Rehabilitation on an
appeal, and shall be conducted by a designated representative under the
supervision of the third level Appeals Chief or equivalent.The third level

review of appeals denied or not otherwise resolved to the appellant's
satisfaction at the first level, or for which the first level is otherwise
waived by these regulations. The second level shall be completed prior
to the appellant filing at the third level as described in subsection
3084.7(c).

review of appeals not resolved at the second level, or:


(1) When the inmate appeals alleged third level staff misconduct or
