Task 3 - Marketing limitations and constraints
Legislation
Sale of goods act 1979
‘The Sale of Goods Act 1979 requires goods to be as described, of satisfactory
quality and fit for purpose. Goods sold must also match any sample you were
shown in store, or any description in a brochure.’ The sales of goods act is a
legislative act that the employees in businesses have to follow. In order to
follow this act, the company has to make sure that the products that they sell
to the customers are of a high quality and high standards. The company has to
make sure that the products are as described and not faulty in any way. For an
example, if a company is advertising and promoting a brand new car that is
described as new but is actually used and faulty in some way then the
company is breaking the law.
The consumer protection from unfair trading regulations 2008
Companies need to make sure that they follow the consumer protection from
unfair trading regulations in order to keep a good reputation for them. For
example, they need to make sure that they do not give any false information
about the products they sell, as it would be a criminal offense to give out false
information about the quality or the price of the items. Businesses cannot
make any false and misleading information about the product, for an example
if a customer purchases a product made out of real leather, which then turns
out to be fake leather instead, the customer has every legal right to claim and
obtain a refund. Another example of this would be if a company advertises a
product and lie about the price as discounted and the customer has to pay full
price in the end when they purchase, then the company is breaking the law.
Distance selling regulations
The distance selling regulations no longer exist in the UK, it was a legislation
that the companies must follow and the rights that the consumer has when
purchasing a product from distance such as online or on the telephone. The
organisations have to give certain information to the buyer, this includes the
description of the products or the service, the price of them, information about
the seller and the delivery costs of the product. For an example, if a customer
purchases a product from online which then they do not like and want to
return it, they have every right to do so within a particular number of days.
