The case of Foskor Limited v Commission for Conciliation, Mediation and Arbitration
and Others involves a dispute between Foskor Limited, an employer, and the
Commission for Conciliation, Mediation and Arbitration (CCMA) and its employees.
Foskor Limited is a mining company that operates in South Africa. The employees,
who are members of a trade union, lodged a dispute with the CCMA regarding the
interpretation and application of certain provisions of their employment contracts. The
dispute was referred to arbitration, and the CCMA issued an arbitration award in favour
of the employees. Foskor Limited then sought to review and set aside the arbitration
award.
