consequence of Ms Goolam’s use of GenAI to draft the report is? (4)
Mr. Lampert, the employment law implications of Ms. Goolam's use of GenAI to create
the report are likely to be regarded workplace misconduct. Sources indicate the
following:
❖ The Ministry of Tertiary Education (MTE) has workplace rules that prohibit the
use of unapproved tools like Generative Artificial Intelligence (GenAI) for work-
related tasks.
❖ Ms. Goolam, as a "Senior Executive Research Specialist," is expected to
conduct research and write reports for the MTE.
❖ The investigation report established that her submitted report was partially
(about 35%) generated using GenAI and contained "largely baseless
information made up by GenAI", including fictional sources.
❖ Using GenAI in violation of the MTE's rules would constitute a breach of a
workplace rule, which is considered misconduct.
❖ Employees have an implied duty to work competently and diligently. Submitting
a report containing fabricated information generated by AI, especially when the
use of such tools is prohibited, could be seen as a failure to fulfill this duty.
❖ An employee can be punished if they were aware, or could reasonably be
expected to have been aware, of the rule. Given Ms. Goolam's senior position
and the Minister's statement about the prohibition of unapproved tools, it is likely
she was aware of this rule.
As a result of her misbehaviour, Ms. Goolam may face disciplinary action from the
MTE, which might result in consequences ranging from suspension to dismissal,
depending on the severity determined by the MTE. The fact that the report includes
false material and fabricated sources only exacerbates the matter.
2. HCTE Chairman: “Counsel, I can see that in one of the annexures to the IR,
Ms Goolam suggests her resort to GenAI was because of the allegedly
unreasonable working hours which she claims violate the law. Kindly tell me
