CONTEMPORARY ISSUES IN BUSINESS LAW


RIGHT TO INFORMATION ACT:

Right to Information Act, 2005 is a landmark for good governance and help to common
citizens especially the poor and under privileged to get their dues from government. The
original of the 'information' is Latin word informare, which means to fashion, shape, or create,
to give from Right to information is a part of fundamental rights of an Indian citizen under
article 19(1) of the constitution Article 19(1) state that every citizen has freedom of speech
and expression

The main aim of this act is to eradicate the existing practice of concealing facts and events
and to empower every citizen to exercise their legal right in obtaining information under the
RTI Act, 2005

'Information' means any material in any form, including records, documents, memos, e-mails,
opinions, advices, press release, circulars, orders, logbooks, contracts, reports, papers,
samples, models, date material held in any electronics form and inf ormation relating to any
private body which can be assessed by a public authority under any other law for the time
being in force.



RIGHT TO INFORMATION
Right to Information is a part of fundamental rights under Article 19(1) of the constitution. As
per section 2(1) of the act "Right to information" means the right to information accessible
under the act, which is held by or under the control of any public authority and includes the
rights to

• Inspection of work, document, records.
• Taking notes, extracts, or certified copies of documents or records. .
• Taking certified samples of materials
• Obtaining information in the form of diskettes, floppies, tapes, video cassettes or in
any other electronic mode or through printouts where such information is stored in a
computer or In any other device.



THE NEED FOR THE RIGHT TO INFORMATION

In recent years, there has been an almost unstoppable global trend towards recognition of
the right to information by countries, intergovernmental organizations, civil society and the

people. The right to information has been recognized as a fundamental human right, which
upholds the inherent dignity of all human beings.

The right to information forms the crucial underpinning of participatory democracy It is
essential to ensure accountability and good governance.

The ideal objectives of the RTI Act are to promote transparency and accountability, the
working of public authority and to set up a practical regime for giving citizens access to
information under the control of public authorities.
RIGHTS UNDER RTI ACT, 2005:

Right to information act, 2005, empowers every citizen to

• Right to seek any information from the public authority
• Right to inspect the work, documents, or records of the government
• Right to take notes extracts or certified copies of documents or records
• Right to take certified samples of materials
• Right to obtain information in the form of diskettes, floppies, tapes, video cassettes or
in any other electronic mode or through print outs, when such information is stored
in a computer or in any other device.
COVERAGE OF THE ACT:

The RTI Act covers

• All levels of the Government Centre, State. District and Local Governing Bodies like
Panchayat and Municipal bodies.
• NGOs that are financed substantially with public funds provided by Government.



FEATURES OF RIGHT TO INFORMATION ACT

The Right to Information Act is a codification of this important right of Citizens. The right
existed since the time India became republic, but was difficult to enforce without going to
Court. The important features of this Act
1. All citizens shall have the right to request for information from the public authority (a
body of government). One does not have to be an adult to do so.
2. Public authority is required to reply expeditiously or within a period of 30 days of the
request for information. If the information sought for concerns one's life or liberty,
information shall be provided within 48 hours of receipt of request.
3. The act gives right to citizen to inspect the work, documents and records of the
government. Citizens can take notes and certified copies of documents and records.
4. Only citizens of India can obtain information under the Act. Incorporated bodies like
companies, societies and co-operative and statutory bodies cannot obtain information
under the Act.
